Terms of Service

These Terms of Service ("Terms") are an agreement between you and Ecarter Technologies Private Limited ("CartWhizz", "we", "us"), GSTIN 09AAGCE0072P1ZB, registered at 2nd, Apna Nagar, Near Mandi Samiti, Transport Nagar, Mathura, Uttar Pradesh 281001, India. They apply when you create or run a store on CartWhizz, visit cartwhizz.com, or use any CartWhizz service. By creating a store you accept these Terms. If you accept them for a business, you confirm you are allowed to bind that business.

1. Your account

  • You must be at least 18 and give us true, current details (name, email, phone, and billing and GST details where needed).
  • Keep your login safe. You are responsible for everything done through your account and your staff accounts.
  • Tell us straight away at [email protected] if you think your account has been misused.

2. Plans, billing and GST

  • Plans, prices and what each plan includes are shown on our pricing page. Prices are shown before GST unless stated otherwise; GST is added at the applicable rate.
  • Plans are billed monthly or yearly, in advance. Some plans also charge a commission or usage fee on sales, which is billed for the month it relates to.
  • Your plan renews automatically at the end of each billing period until you cancel. If you saved a payment method, we charge it when the invoice is issued; otherwise we email you a secure link to pay.
  • We issue a GST tax invoice for every charge. Add your business name, GSTIN and address in your billing details so the invoice carries them.
  • If an invoice is not paid, we send reminders. If it stays unpaid after the due date and the grace period, we may pause (suspend) your store until it is paid. Suspension never deletes your data, and paying the invoice brings the store back.
  • We may change prices for future billing periods. We will tell you by email at least 30 days before a price change affects you.
  • Cancellations and refunds are covered by our Refund & Cancellation Policy.

3. Acceptable use

You must not use CartWhizz to:

  • sell anything illegal in India or in the place you sell to, or anything that needs a licence you do not hold;
  • sell counterfeit goods or infringe anyone's trademark, copyright or other rights;
  • mislead or defraud shoppers, or run phishing, spam or malware;
  • attack, overload, probe or copy the platform, or get around any limit or security measure;
  • resell or white-label CartWhizz without a written agreement with us.

We may remove content or products that break these rules.

4. Your store and your responsibilities

  • Your store, products, prices, descriptions, images and policies are your content, and you are responsible for them. You give us permission to host, copy and display that content only to run the service.
  • You are the seller to your shoppers. Delivery, returns, refunds, warranties, taxes on your sales and customer service are your responsibility.
  • You must publish your own terms, privacy, refund and shipping policies for your shoppers, and follow the laws that apply to you, including consumer protection, e-commerce, tax and data protection laws.
  • You control your shoppers' personal data. We process it for you, only to provide the service, as described in our Privacy Policy.
  • Payment gateways, couriers and other services you connect to your store are provided by those companies under their own terms. We are not responsible for them.

5. CartWhizz AI

CartWhizz AI suggests answers, product text, reports and actions. It can be wrong. Check its output before you rely on it or publish it. Changes it proposes are made only after you confirm them, and you are responsible for the changes you confirm.

6. "Powered by CartWhizz"

Storefronts show a small "Powered by CartWhizz" line with a link in the footer. It can be removed only on plans that include white-label. Do not hide it in any other way.

7. Custom domains

You may connect a domain you own. You keep it registered and renewed with your registrar and point it to us as shown in your admin. We issue the security certificate for it. If the domain lapses or is pointed elsewhere, the store stays available on its CartWhizz address.

8. Backups and your data

We take regular backups to protect the service. You should also keep your own copies of important data, such as product exports and order reports. You can export your data at any time while your account is active. After your account closes, we may delete your store data, apart from records we must keep by law.

9. Suspension and termination

  • You can close your store at any time from your admin or by writing to [email protected].
  • We may suspend or close a store that breaks these Terms, has unpaid invoices, or puts shoppers, other merchants or the platform at risk. Where we reasonably can, we will warn you first and give you a chance to fix the problem.

10. Our service

We work to keep CartWhizz available, secure and up to date, but we cannot promise it will be uninterrupted or error-free. We may improve, change or remove features. We will tell you in advance about any change that significantly reduces a paid feature you use.

11. Liability

  • The service is provided "as is", to the extent the law allows.
  • We are not liable for indirect or consequential losses, such as lost profits, lost sales or lost data, or for the acts of third-party services you connect.
  • Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim.
  • Nothing in these Terms limits liability that cannot be limited by law.
  • You will compensate us for claims made against us because of your store's content, products or breach of these Terms.

12. Governing law

These Terms are governed by the laws of India. The courts at Mathura, Uttar Pradesh have exclusive jurisdiction.

13. Changes to these Terms

We may update these Terms. We will post the new version here with a new "Last updated" date, and email you about important changes before they take effect. If you keep using CartWhizz after that, the new Terms apply.
